1. Acceptance of Terms

By accessing, using, or purchasing the services offered by Youbooks ("Service"), you ("User") are agreeing to be bound by these Terms of Service ("TOS"). We may modify these TOS from time to time. It is your responsibility to review these TOS periodically, and if at any time you find these TOS unacceptable, you must immediately cease all use of the Service. Your continued use of the Service signifies your acceptance of the revised TOS.

By using our services, you assert that you are of legal age to enter into this Agreement, or, if you are not, that you have obtained parental or guardian consent to enter into this Agreement.

2. Services

Youbooks offers advanced AI-powered writing services, specializing in the generation of book content. Our platform employs innovative technologies, including AI models and Vector databases, ensuring our users receive content that is not only insightful but also tailor-made to their preferences and needs.

2.1 Service Description

Youbooks allows users to:

Use the Youbooks SaaS to generate non-fiction content with customizable writing styles and word counts.

Upload or opt-out of providing sources, while maintaining content reliability and accuracy.

Receive content in multiple formats including docx, epub, and markdown.

Utilize the content for commercial purposes, subject to compliance with applicable laws and distribution platform policies.

2.2 User Responsibilities

Users are responsible for:

Providing accurate and lawful information and sources when using Youbooks.

Securing necessary permissions or licenses for the use of copyrighted materials.

Adhering to applicable laws, regulations, and ethical standards when utilizing the content generated.

2.3 Limitations

While Youbooks strives to provide top-notch content:

We do not guarantee the content to be error-free or to suit every user’s individual preferences or expectations.

We do not guarantee the content will be 100% plagiarism free. Large Language Models are trained on a wide range of data, including other people's work. This may result in the content being similar to other works. Users should use a plagiarism checker to ensure the content is unique.

Users are urged to review and edit the content as needed to meet their specific requirements.

Any liability arising from the use of the service, including the use of generated content, rests solely with the user.

2.4 Availability & Modifications

Youbooks reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We shall not be liable to any user or third party for any modification, suspension, or discontinuance of the service.

3. User Responsibilities

Users of Youbooks are required to uphold the following responsibilities:

Legal Compliance: Users must comply with all applicable local, state, national, and international laws and regulations when using Youbooks. Users are expressly prohibited from violating any laws relating to the intellectual property rights of others and uploading unlawful content.

Content Provision: Users are responsible for all content they upload to Youbooks and must ensure they have the right to use and share such content. Users are prohibited from uploading content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

Intellectual Property Rights: Users are responsible for obtaining any permissions or licenses required by content providers or copyright holders for uploaded sources. Any liability arising from the use of copyrighted material without proper authorization rests solely with the user. Users are urged to ensure compliance with applicable copyright laws, licensing agreements, and other relevant legal and ethical standards.

Permissions and Licenses: If uploading content or sources that are not owned by the user, it is the user’s responsibility to secure necessary permissions or licenses from the rightful owners or license holders. Users must not upload content that infringes on the intellectual property rights of others.

Indemnification: Users agree to indemnify and hold harmless Youbooks, its affiliates, officers, directors, employees, agents, suppliers, or licensors from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of their use or misuse of Youbooks, violation of these TOS, or breach of their responsibilities and obligations as stated in this section.

Failure to comply with these responsibilities may result in immediate termination of access to Youbooks and legal action. Youbooks expressly disclaims any liability in connection with user-provided content and user conduct.

4. Content Ownership and Usage

4.1 User Ownership: Users retain all ownership rights to the content they create using the Youbooks SaaS. Youbooks does not claim any ownership rights to user-generated content.

4.2 User Responsibility: Users are solely responsible for the content they create using Youbooks. They are obliged to ensure that the content adheres to applicable laws, standards, and the guidelines outlined in these Terms of Service.

4.3 Content Review: Youbooks reserves the right, but is not obligated, to review and remove any content that violates these Terms of Service or is otherwise objectionable.

4.4 Copyright Infringement: If you believe that your content has been used in a way that constitutes copyright infringement, please contact us immediately at master@youbooks.com with the subject line “Copyright Infringement”.

4.5 Third-Party Content: Youbooks may display content from third parties. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any third-party content and you acknowledge that all content accessed by you using the services is at your own risk and you will be solely responsible for any damage or loss arising therefrom.

4.6 Commercial Exploitation: Users are free to commercially exploit the content they create through Youbooks, provided they comply with all applicable laws and third-party rights, and acknowledge that Youbooks shall not be liable for any claims arising from the commercial exploitation of such content.

4.7 Indemnification: Users agree to defend, indemnify, and hold harmless Youbooks, its parent corporation, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from the user’s violation of any term of these Terms of Service or third-party right, or any harm or loss caused by user-generated content.

5. Data Security and Privacy

Youbooks prioritizes the protection of user data and privacy, employing stringent measures to ensure the security, confidentiality, and integrity of user information. Our commitment is to provide a secure environment for our users, fostering trust and reliability in our services.

6. Commercial Use and Publication

Content developed and finalized through Youbooks is permitted for commercial use, allowing users the freedom to disseminate, publish, and sell their creations across varied platforms, mediums, and distribution channels, including but not limited to, eBooks, Print on Demand (POD) services, and traditional publishing avenues.

6.1 Disclosure and Transparency: Users intending to publish their AI-generated content on platforms like Amazon or any other publication services are required to disclose the AI-generated nature of the content to maintain transparency and adherence to platform policies. Such disclosures ensure compliance with the ethical norms and guidelines of publishing platforms and help in building trust with the readership.

6.2 Compliance with Publisher’s Terms: While publishing content generated through Youbooks, users must diligently review and comply with the terms of service, guidelines, and policies stipulated by the chosen publisher, distributor, or platform. Users are responsible for understanding and adhering to the specific requirements, restrictions, and conditions imposed by each entity to prevent any legal disputes or publication hindrances.

6.3 Intellectual Property Rights: Users retain the intellectual property rights to the content created using Youbooks services, subject to any rights granted to Youbooks under these Terms of Service. Users are responsible for protecting their intellectual property rights in the content, including, when appropriate, by securing copyright and trademark protections.

6.4 Indemnification: Users agree to indemnify and hold harmless Youbooks and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, arising out of or related to the commercial use, publication, or dissemination of content created using Youbooks services, or the violation of any third-party rights, including intellectual property rights, in connection with such content.

6.5 Representations and Warranties: Users represent and warrant that their commercial use of content generated through Youbooks does not infringe or violate the rights of any third party, including intellectual property rights, and complies with all applicable laws, regulations, and ordinances.

By utilizing Youbooks for commercial purposes, users acknowledge their understanding and agreement to comply with the aforementioned conditions, ensuring responsible and lawful use of Youbooks services for commercial endeavors.

7. Pricing and Payment

Access to and use of Youbooks services are subject to the following pricing and payment terms:

7.1 Service Pricing

The cost for utilizing Youbooks services is determined by various factors including, but not limited to, the number of words, the chosen AI model, and the selection of additional optional features. Prices generally range between $0.0001 and $0.0015 per word plus a setup fee.

7.2 Quotations

Before placing an order, users will receive a quote based on their specific inputs and requirements. This quote will provide a detailed breakdown of the costs associated with the project. The quote represents the maximum amount the user will be charged should Youbooks deliver the requested word count or above. If Youbooks delivers a word count below the target word count, the final charged amount will be adjusted pro-rata.

7.3 Payment Methods

Payments are accepted through through credit/debit cards. Youbooks uses Stripe to process payments. All payments must be made in accordance with the payment instructions provided at the time of order placement.

7.4 Invoices and Receipts

Upon successful completion of the payment process, users will receive an invoice/receipt acknowledging the payment, sent to the user's provided email address.

7.5 Refunds and Cancellations

User can request a refund if the generated content is considerably sub-par. Please submit your refund request to master@youbooks.com. Refund requests must be submitted within 7 days of the order being delivered.

7.6 Changes to Pricing

Youbooks reserves the right to modify the pricing of its services at any time without prior notice. Any changes in pricing will not affect orders already placed and confirmed.

7.7 Taxes

All service prices are exclusive of any applicable taxes, levies, or duties imposed by taxing authorities. Users are responsible for payment of all such taxes, levies, or duties.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOUBOOKS, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF YOUBOOKS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY OTHER DEALINGS WITH YOUBOOKS.

IN NO EVENT SHALL YOUBOOKS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID YOUBOOKS IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF YOUBOOKS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such cases, Youbooks’s liability will be limited to the fullest extent permitted by applicable law.

9. Changes to Terms of Service

Youbooks reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Service ("TOS"), at any time ("TOS Changes"). It is your responsibility to check these TOS periodically for changes. Updated versions of the TOS will be posted on our website and the date of the newest version will be stated at the top of this TOS.

Users will be notified of any TOS Changes through email or conspicuous posting on our website. In some cases, Youbooks might provide additional notice, such as adding a statement to the homepage or sending you a notification through email.

Continued use of the Youbooks services following the posting of changes will mean that you accept and agree to the TOS Changes. If you do not agree to the TOS Changes, you must stop using the Youbooks services immediately. Any TOS Changes will apply prospectively from the date of change.

Your use of the Youbooks services after the effectiveness of such changes will constitute acceptance of and agreement to any such changes. You may reject any changes to this TOS by discontinuing use of the Youbooks services.

10. Governing Law and Jurisdiction

These Terms of Service and any disputes or claims arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Cyprus. Both parties irrevocably agree that the courts of Cyprus shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms of Service or its subject matter or formation (including non-contractual disputes or claims).
